Civil rights and police misconduct cases can be difficult matters to litigate, as courts have created numerous obstacles that one must overcome to even make it to the trial level. DEATH IN CUSTODY OR DENIED MEDICAL TREATMENT
A person in custody still has the constitutional right to medical care, especially for serious medical conditions, including mental health issues. The responsibility for their medical care falls on the jail or prison authorities. It is considered cruel and unusual punishment to deny medical care, and despite this right, there have been cases where critical medical care has been denied to inmates by correctional officers and jail medical personnel. Civil Appeals are time sensitive and must be filed within an allowed time period. In domestic relations/divorce cases, for example, an appeal must be filed within 42 days after a divorce is final or you lose your right to appeal. I have been doing civil appeals for 24 years. Not all attorneys do appeals. In appealing a case, I research and write about errors that the judge or lawyers made before, during, or after a trial in a lower court. I present these errors to the appellate courts in a brief for their review. The appeals courts can then determine if the law and rules were followed in the case. If the laws were not followed, the appellate courts will reverse the decision or send the case back to the lower court for further action.
